On December 1, 2022, Ukraine passed a law titled "On Ensuring Chemical Safety and Management of Chemical Products," which came into effect on June 29, 2024. Articles 35 and 36 of the law stipulate that classification and labeling must conform to the global GHS system. This legislation is part of Ukraine's commitment to align with European standards, aimed at protecting public health and the environment.
Subsequently, on May 10, 2024, the Ukrainian Ministry of Environment and Natural Resources announced the "Technical Regulation on the Classification, Labeling, and Packaging of Chemical Products" (UA-CLP), aligning with the EU CLP Regulation (EU Regulation 1272/2008) and the United Nations GHS regulations. The official name of the regulation is "Про затвердження Технічного регламенту класифікації небезпечності, маркування та пакування хімічної продукції" (Approval of the Technical Regulation for the classification of hazards, labeling, and packaging of chemical products).
UA CLP will come into effect six months after its publication, on November 15, 2024. Products that were already on the market before November 15, 2024, even if they do not comply with the current technical regulations, can continue to be marketed until November 14, 2025, providing a one-year transition period.
The following two sections will come into effect on January 1, 2025:
- Part 3: Marking of chemical products with hazard information
- Part 6: Articles 130-133: Ensuring the safety and management of chemicals through authorized bodies
The structure of UA CLP is essentially consistent with the EU CLP, covering 33 major hazard categories related to physical, health, and environmental risks, with labeling and packaging requirements nearly identical to those of the EU.
Additionally, in July 2023, Ukraine officially announced the Technical regulation for the safety of chemical products (referred to as UA REACH), which also incorporates GHS-related requirements, including the explicit requirement to provide Safety Data Sheets (SDS) for chemicals.
UA CLP does not apply to "finished products intended for the final consumer" such as medical devices, veterinary products, food or feed, cosmetics, and tobacco products. Although cosmetic products are exempt from UA CLP, the raw materials used to make cosmetics are subject to UA CLP control. This is particularly important for raw materials containing CMR (Carcinogenic, Mutagenic, or toxic to Reproduction category 1A or 1B) substances or mixtures, as classification decisions under the new UA CLP regulations can avoid the use of similar materials.
