On March 1, 2024, the European Chemicals Agency (ECHA) proposed the inclusion of two chemical substances in the Candidate List of Substances of Very High Concern (SVHC). This proposal has now entered a public consultation phase, which will remain open until April 15, 2024. During this period, all stakeholders are invited to submit their feedback and comments to the ECHA, contributing to the agency’s decision-making process in the identification and management of potentially hazardous chemicals within the EU.

Reminder
If the products exported to Europe contain more than 0.1% SVHC, enterprises are required to make information transmission and SCIP notification, if the content of SVHC exceeds 1 t/y, SVHC notification should also be made.
Legal Obligations
Enterprises shall undertake relevant legal obligations:
1. Suppliers of articles containing a Candidate List substance above a concentration of 0.1%(weight by weight) shall provide relevant information to concerned parties;
2. Consumers have the right to ask suppliers whether the products obtain sufficient information of products within 45 days, including substance name and content;
3. If the export volume exceeds 1t/y, importers and manufacturers of articles will have to notify ECHA if their articles contains a Candidate List substance within 6 months from the date it has been included in the list;
4. From 5 January 2021, companies have to notify ECHA if the articles containing SVHC substances in a concentration above 0.1% (weight by weight). Notification shall be published in the SCIP database of ECHA.
5. Since it is potential for SVHC substances to be added to the Authorisation List, enterprises shall apply for authorisation for further use.
