According to the "Decision on Setting Administrative Permissions for Administrative Approval Items that Must Be Retained" (Order No. 412 of the State Council), the approval of transboundary movements of hazardous waste is an administrative approval matter handled by the Ministry of Environmental Protection. The specific approval procedures are as follows:
- Acceptance of application. Export applicants submit the application materials required by Chapter 2, Article 5 of the "Administrative Measures for Examination and Approval of the Export of Hazardous Wastes" to the Ministry of Environmental Protection. The Ministry accepts applications that are complete and meet the requirements.
- Technical review. The Ministry of Environmental Protection entrusts the Technical Center for Solid Waste and Chemicals Management to conduct a written review of the materials and, if necessary, to carry out on-site verification and provide preliminary approval recommendations.
- Preliminary approval. The Ministry of Environmental Protection conducts a preliminary approval of the application for hazardous waste export in accordance with the requirements of Chapter 2, Article 7 of the "Administrative Measures for Examination and Approval of the Export of Hazardous Wastes."
- Implementing the prior informed consent procedure. For applications that are preliminarily approved, letters of inquiry are sent to the competent authorities of the Basel Convention in the importing country (region) and transit countries (regions).
- Final approval. After receiving written consent from the importing and transit countries (regions) to import or transit, the Ministry of Environmental Protection approves the export activity, issues the "Hazardous Waste Export Approval Notification" to the applicant, and notifies the environmental protection administrative departments of the provincial people's governments where the hazardous waste is located and along the domestic transit route.
