What conditions must be met for the transboundary movement of hazardous wastes?

1. The importer is a party to the Basel Convention;

2. The application materials must meet the requirements of Article 5, Chapter 2 of the "Administrative Measures for Examination and Approval of the Export of Hazardous Wastes"; the utilizer in the importing country (region) needs to use the hazardous waste as raw materials for recycling or recovery industries, and must have the corresponding technical capabilities, necessary facilities, equipment, and premises to utilize the hazardous waste in an environmentally harmless manner;

3. Or, if China lacks the sufficient technical capabilities and necessary facilities, equipment, or appropriate disposal sites to dispose of the hazardous waste in an environmentally harmless manner, and the disposer in the importing country (region) has the corresponding technical capabilities, necessary facilities, equipment, and premises, and can dispose of the hazardous waste in an environmentally harmless manner.
