China-When does an exporter need to apply for an export license?

Under Article 12 of the "Export Control Law", exporters must apply for a license from the national export control authorities for items listed in the export control list or temporary control items. For goods, technology, and services not listed in the export control list or temporary control items, exporters should apply for a license if they know, should know, or are informed by the national export control authorities that the related goods, technology, or services may pose the following risks:

  1. Endanger national security and interests;
  2. Be used in the design, development, production, or use of weapons of mass destruction and their delivery vehicles;
  3. Be used for terrorist purposes.
    If exporters are unsure whether the goods, technology, or services they plan to export fall under the controlled items specified by this law, they should consult the national export control authorities, who should respond promptly.
