If Company A in China commissions Company B, also within China, to produce a new chemical substance, should Company A or Company B handle the registration of the new chemical substance before production?

The actual producer, Company B, should handle the registration of the new chemical substance and must clearly note the information of the commissioning party, Company A, in the application form. It is important to note that Company B must comply with Article 11 of the "Measures for the Environmental Management Registration of New Chemical Substances" (Ministry of Ecology and Environment Order No. 12) and Section 1.4 of Chapter 1 in the "Guidelines for the Environmental Management Registration of New Chemical Substances" (Ministry of Ecology and Environment Announcement No. 51 of 2020) regarding the applicant's requirements.
