India Publishes QCOs for Five Polymer Products

On 6 December 2023, the Central Government of India, after consultation with the Bureau of Indian Standards (BIS), published a Gazette Notification regarding the Quality Control Order (QCO) for five polymer products in its Official Gazette, which shows the India government's commitment to improving the quality of domestic products.

Previously on September 13, 2023, TBT has published a notice on seeking public comments for the drafted QCOs for these five polymers. These five QCOs are scheduled to be effective after 180 days from the publication date on the Official Gazette. Once effective, goods or articles in the QCO are required to obtain corresponding certificates from BIS and meet the Indian Standard. Moreover, these goods or articles should have the BIS standard mark. Otherwise, goods or articles are not allowed to be manufactured, distributed, leased, or stored. Manufacturers outside India are required to obtain BIS certificate or CoC.

Legal Basis

In accordance with the provision of Article 16 of the BIS Act 2016, the Central Government may, after consultation with the Bureau, publish an order in the Official Gazette notifying goods or articles under specific standard and its use of the Standard Mark under a license or certificate of conformity as compulsory on such goods or articles.

As specified in Article 17 of the BIS Act 2016, no person shall manufacture, import, distribute, sell, hire, lease, store or exhibit for sale any goods or articles without a Standard Mark except under a valid license or in conformity with the relevant standard or prescribed essential requirements.

Therefore, articles or goods must obtain BIS certificate before their manufacture, sell and import.
