New Canadian Bill Plans to Ban Manufacture and Sale of Coal Tar Sealants

In November 2023, the Department of the Environment and the Department of Health of Canada introduced the Certain Products Containing Toxic Substances Regulations which intends to ban the production, importation, and sale of specific coal tar-based sealant products and any sealant product with over 1,000 ppm of PAH.

The proposed Regulations also prohibits the sale and promise to sell the product containing coal tar and PAHs with concentration limits greater than 1,000 ppm by 30th June 2025, unless imported under a permit. Alternatively, the product should be sold no later than one month later. Furthermore, the proposed Regulations aims to repeal and consolidate the 2-butoxyethanol regulation (2-BE Regulation) without making any substantial changes.

This proposed Regulations is under public consultation for a 70-day comment period before 27th January 2024. The effective date is scheduled to be on 1st January 2025.
