The priority management chemicals in Taiwan are regulated by the Regulations for Governing Designating and Handling of Priority Management Chemicals (hereinafter referred to as the Priority Management Regulations) under the Occupational Safety and Health Act. The Priority Management Regulations came into effect on January 1, 2015. The list of priority management chemicals in Taiwan—"Regulations for Governing Designating and Handling of Priority Management Chemicals (version 2.3) " refers to the 163 chemical substances specified in Provision 3 of Article 2 of the "Priority Management Regulations", including mixtures containing hazardous components of the aforementioned 163 chemicals.
► Chemical substances included in the list of priority management chemicals in Taiwan- "Regulations for Governing Designating and Handling of Priority Management Chemicals (version 2.3)," which reach the threshold amounts specified in Appendix III of the "Priority Management Regulations," require operators (including manufacturers, importers, suppliers, or employers) to file for record-keeping. In an operational site, if any single chemical from the list reaches the threshold amount specified in Appendix III, other chemicals from the same list, even if they do not reach the threshold, must also be filed for record-keeping. If there are two or more chemicals listed but none meet the threshold amounts, the total combined amount should be calculated to determine if filing is required. The specific conditions and calculation methods are as follows:
- If the maximum operational amount of a chemical is less than or equal to 2% of its threshold amount, that chemical is exempt from the calculation and the filing requirement.
- If the maximum operational amount of a chemical exceeds 2% of its threshold amount, the calculation should be performed using the following formula: if the sum ≥ 1, all chemicals must be filed for record-keeping; if the sum < 1, none of the chemicals need to be filed for record-keeping.
Note: When a single chemical has more than two hazard classifications, the lowest threshold amount should be used for calculations.
If the number of workers at the operator's site reaches 100 or more, they must file for record-keeping within 6 months from the date of the official announcement by the competent authority; if fewer than 100 workers, within 12 months. Additionally, after completing the initial record-keeping, enterprises must file for record-keeping again in January and July each year, i.e., a semi-annual check (applicable under Provision 3 of Article 2 of the "Priority Management Regulations").
After completing the initial or regular record-keeping, if the total amount of chemicals operated by the enterprise exceeds the threshold specified in Appendix III of the "Priority Management Regulations," a dynamic record-keeping must be completed within 30 days after exceeding the threshold (applicable under Provision 3 of Article 2 of the "Priority Management Regulations").
