The priority management chemicals in Taiwan,China are regulated by the Regulations for Governing Designating and Handling of Priority Management Chemicals (hereinafter referred to as the Priority Management Regulations) under the Occupational Safety and Health Act, which came into effect on January 1, 2015. Article 2.2 of Taiwan's "Regulations on the Designation and Operation Management of Priority Management Chemicals" refers to the chemicals designated under Provision 2 of Article 2 of the "Priority Management Regulations." This includes a total of 889 chemical substances, as well as mixtures containing more than 1% by weight of the aforementioned 889 chemicals.

For chemical substances listed in "List of Priority Management Chemicals in Taiwan, China-Appendix 2 (version 2.2)":

1. If the substance is a carcinogen, germ cell mutagen, or reproductive toxicant of Category 1 (CMR1) and the concentration of this hazardous component (as a percentage by weight) is 1%, regardless of the total annual amount operated, the operator (including manufacturers, importers, suppliers, or employers) must register for inspection.

2. If the substance is not a carcinogen, germ cell mutagen, or reproductive toxicant of Category 1 (non-CMR1), and the concentration of this hazardous component (as a percentage by weight) is 1% and the annual total amount of any operational activity involving the chemical is 1 ton, the operator (including manufacturers, importers, suppliers, or employers) must also register for inspection.

If the operator has 100 or more employees, they must register for inspection within 6 months from the date of the announcement by the competent authority. If the operator has fewer than 100 employees, they must register within 12 months from the date of the announcement.

Furthermore, starting from the year following the inspection registration, enterprises need to conduct regular updates of operational data between April and September each year to maintain the timeliness and validity of the operator's inspection data. This is known as the annual periodic inspection (applicable to version 2.1 and 2.2 of the "Priority Management Regulations").

Chemical substances that are not included in the List of Priority Management Chemicals (version 2.2) are not subject to corresponding obligations.

Exemptions

  1. Hazardous industrial waste;
  2. Tobacco or tobacco products;
  3. Food, beverages, medications, and cosmetics;
  4. Finished goods;
  5. General consumer goods for non-industrial purposes in daily life;
  6. Fire extinguisher;
  7. The intermediate product of a chemical reaction that is currently taking place in a reactor or process;
  8. Other items designated by the central competent authority.
