Catalog of Hazardous Chemicals in China (2022)

According to the Safe Management of Hazardous Chemicals (Order No.591 of the State Council), the State Administration of Work Safety (SAWS, now replaced by the Ministry of Emergency Management), in conjunction with the Ministry of Industry and Information, the Ministry of Public Safety, the Ministry of Environmental Protection (now replaced by the Ministry of Ecology and Environment), the Ministry of Transport, the Ministry of Agriculture, the National Health and Family Planning Commission, the General Administration of Quality Supervision, Inspection and Quarantine, the Railway Administration of China and the Civil Aviation Administration of China,released the Catalog of Hazardous Chemicals (2015) in February 2015, which came into effect on May 1, 2015. The Catalog of Hazardous Chemicals (2002 , SAWS Order No.1, 2003) and the List of Highly Toxic Chemicals (2002 , Announcement No.2, 2003 of Eight Ministries including SAWS) shall be repealed hereby.

The Catalog of Hazardous Chemicals includes a total of 2828 chemicals. According to the series of national standards of the Rules for Classification and Labelling of Chemicals, 81 out of the 95 hazard categories of 28 classifications of chemicals that with higher hazardous level have been selected as the determination criteria for hazardous chemicals. In addition, 10 entries in the 2002 version have been combined into the Entry 2828 (i.e. synthetic resins, paints, auxiliary materials, coatings and other products containing flammable solvents [closed cup flash point ≥ 60℃]).

► Hazardous chemicals listed in the Catalog of Hazardous Chemicals (2015) will be subject to key management by administrative permits and other measures in accordance with relevant national laws and regulations.

► Chemicals that are not listed in the Catalog of Hazardous Chemicals (2015) may also be hazardous chemicals. In order to fully understand the hazardous properties of hazardous chemicals in China, mixtures and hazardous chemicals not listed in the Catalog shall be subject to identification and classification in accordance with the Measures for the Administration of Identification and Classification of Physical Hazards of Chemicals (SAWS Order No.60) and other relevant provisions. If these substances are classified as hazardous chemicals, they shall be subject to Measures for the Administration of Registration of Hazardous Chemicals (SAWS Order No.53) for purpose of source management and safe use. The combination of catalog management,chemical registration system,  identification and classification provides a comprehensive coverage of safe management of hazardous chemicals.

► On February 16 , 2022, the Comprehensive Service System for Registration of Hazardous Chemicals will be put into operation, allowing companies registering hazardous chemicals to complete information to obtain a safety information code.

► On November 7, 2022, ten ministries in China revised the Catalog of Hazardous Chemicals and adjusted “No.1674 diesel oil [closed cup flashing point below 60℃]” to “No.1674 diesel oil.” This implies that all types of diesel will now be considered as hazardous chemicals subject to the Catalog, regardless of its flashing point. Moreover, administrative licenses, including production license and the management license, are required for all types of diesel (except when used as fuel).

Regardless of whether the chemical is listed in the Catalog of Hazardous Chemicals (2015), it is necessary to confirm whether the chemical is listed in the Inventory of Hazardous Chemicals under Key Supervision (2013), the List of Highly Toxic Chemicals (2015), the List of Precursor Chemicals, the List of Hazardous Chemicals under Key Supervision, the Catalog of Explosive Precursors (2017),etc. If listed, related obligations shall be met, including registration and permits, etc.
